PLEASE READ THIS AGREEMENT CAREFULLY. THIS IS A LEGAL AGREEMENT BETWEEN YOU AND VOWREAD.

This Terms of Service Agreement ("Terms," "Agreement") governs your access to and use of the Vowread mobile application and related online services (collectively, the "Services"). By accessing or using our Services, you confirm your acceptance of these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Services.

We may modify these Terms periodically. We will notify you of changes through the Services or via email. Your continued use after such notice constitutes acceptance of the modified Terms.

1. ELIGIBILITY AND REGISTRATION

1.1 Age Requirement. You must be at least 13 years old to use our Services. We do not knowingly collect information from children under 13. By using the Services, you represent that you are not required to register as a sex offender with any government entity.

1.2 Account Creation. To access certain features, you must create an account by providing accurate information, such as a username and password. You may also register using certain third-party services, subject to that service's privacy policy.

1.3 Account Security. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

1.4 Account Termination. You may request account deletion by contacting service@playtastic.uk. Deletion is permanent, and content cannot be recovered. We reserve the right to suspend or terminate your account for any violation of these Terms or for any other reason that might harm our Services or other users.

2. USER CONDUCT AND RESPONSIBILITIES

You agree not to use the Services to:

- 2.1 Create, upload, or transmit any content that is inaccurate, unlawful, infringing, defamatory, obscene, pornographic, invasive of privacy, harassing, threatening, abusive, inflammatory, or otherwise objectionable.

- 2.2 Impersonate any person or entity or access accounts without permission.

- 2.3 Harass, abuse, threaten, defraud users, or collect their personal information without consent.

- 2.4 Interfere with the security-related features of the Services, remove any proprietary rights notices, or reverse engineer any part of the Services (except as permitted by law).

- 2.5 Upload viruses or other malicious code or interfere with the operation of the Services or other users' enjoyment.

- 2.6 Use automated tools like robots or spiders to access or scrape the Services.

- 2.7 Attempt to bypass content filtering techniques or access unauthorised areas of the Services.

- 2.8 Use the Services for any illegal purpose or in violation of any applicable laws.

3. USER-GENERATED CONTENT

3.1 License Grant. By submitting content ("User Content"), you grant Vowread a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and sub-licensable license to use, modify, adapt, publish, translate, create derivative works from, and display such content in connection with the Services.

3.2 Your Warranties. You warrant that your User Content does not violate any third-party rights (including copyright, trademark, and privacy rights) or any applicable laws. You waive any moral or similar rights in the User Content.

3.3 Content Moderation. Vowread reserves the right, but not the obligation, to monitor, screen, edit, or remove User Content at any time for any reason, including if it violates these Terms. Vowread is not responsible for and does not endorse any User Content.

3.4 Indemnification. You agree to indemnify Vowread against any claims arising from your User Content or your breach of these Terms.

4. VIRTUAL ITEMS, SUBSCRIPTIONS AND PAYMENTS

4.1 Virtual Tokens. You may purchase virtual tokens ("Tokens") with real money. Tokens are a licensed, non-transferable virtual currency for use only within the Services. They have no cash value and are non-refundable, without prejudice to your statutory cancellation rights.

4.2 Purchases and Your Legal Rights.

- All charges and payments are made in the specified currency.

- As a consumer, you have legal rights under the Consumer Rights Act 2015. Nothing in these Terms will affect these mandatory legal rights.

- For most digital content, you lose your right to cancel once the download or streaming begins. However, if the content is faulty, you are entitled to a repair, replacement, or refund.

- For subscription services, you may have a right to cancel under the Consumer Contracts Regulations 2013 within 14 days of purchase, unless you have started streaming the content.

4.3 Subscription Services.

- Subscriptions automatically renew unless you disable auto-renewal at least 24 hours before the current period ends.

- You can manage and cancel subscriptions through your device's app store (Apple App Store or Google Play Store).

- Introductory offers and free trials are for first-time subscribers only.

- We may change subscription prices and features at any time, with notice to you.

5. INTELLECTUAL PROPERTY

Vowread owns all content, data, and materials contained in the Services, which are protected by copyright, trademark, and other laws. Except for the limited license to use the Services, these Terms do not grant you any intellectual property rights.

6. COPYRIGHT AND INTELLECTUAL PROPERTY INFRINGEMENT

If you believe your copyright or other intellectual property right has been infringed, please send a notice to our Designated Agent at:

Your notice must include the information required by applicable UK intellectual property law and regulations. We will terminate the accounts of repeat infringers.

7. DISCLAIMERS AND LIMITATION OF LIABILITY

7.1 "As Is" Service. The Services are provided on an "as is" and "as available" basis without warranties of any kind, except as required by law. We are not liable for any user content, user conduct, or any errors or interruptions in the Services.

7.2 Limitation of Liability.

- Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded under English law.

- Subject to the above, to the fullest extent permitted by law, Vowread shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising from your use of the Services.

8. GOVERNING LAW AND DISPUTE RESOLUTION

8.1 Governing Law. This Agreement and any dispute or claim arising out of it shall be governed by and construed in accordance with the laws of England and Wales.

8.2 Jurisdiction. You and we both agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of this Agreement.

8.3 Alternative Dispute Resolution. As a consumer, you have the right to submit a complaint via the European Commission's Online Dispute Resolution platform or to other certified alternative dispute resolution providers in the UK. We would, however, appreciate the chance to deal with your concerns before you approach any such body, so please contact us in the first instance.

9. FINAL TERMS

These Terms make up the entire agreement between you and Vowread and supersede any prior agreements.

These Terms do not create or confer any third-party beneficiary rights.

If we do not enforce a provision in these Terms, it will not be considered a waiver.

We reserve all rights not expressly granted to you.

You may not transfer any of your rights or obligations under these Terms without our consent.

These Terms were written in English and to the extent the translated version of these Terms conflicts with the English version, the English version will control.
